Terms of Service

1. Who we are
"Ever in Light" is a trade name (brand) of Global Management Studio s.r.o., a limited liability company incorporated under the laws of the Czech Republic, registered office Došlíkova 3051/17, 636 00 Brno, Czech Republic, Company ID (IČO): 28238753, VAT ID (DIČ): CZ28238753, registered in the Commercial Register maintained by the Regional Court in Brno, File No. C 148935. Contact: hello@everinlight.com ("Provider", "we"). These Terms govern every order placed through everinlight.com ("you", "customer"). All contracts concluded under the Ever in Light brand are concluded with Global Management Studio s.r.o.
2. What we provide
We provide our services to customers worldwide. We create personalised digital keepsake films from photographs and materials you supply: The Living Moment (one animated photograph, up to 10 seconds), Six Moments (a sequence of six animated photographs, up to one minute, with optional letter and optional licensed music), and The Tribute Film (a 3–5 minute film with licensed music, titles, gentle animation, and photo restoration), each as described on the Pricing page at the time of your order, including listed add-ons.
3. Ordering and contract
You place an order through the order form (and, where available, payment through Stripe). The contract is concluded when we confirm your order by email. We may decline an order, for example where the materials are insufficient or the content is unlawful, in which case any payment is refunded in full.
4. Prices, payment and taxes
Prices are listed in US dollars and are final for the customer; no additional taxes or fees are added at checkout, regardless of the country you order from. The Provider is registered for VAT in the Czech Republic (VAT ID CZ28238753). The services are electronically supplied services with the place of supply at the customer's residence: for customers residing outside the European Union no VAT is charged, and for customers residing in the European Union any applicable VAT is included in the price and accounted for by the Provider in accordance with EU legislation. Payment is processed by Stripe. Where payment details are sent by email (before online payment is enabled), work begins after payment is received.
5. Delivery
Films are delivered digitally, via a private link, typically within 24–48 hours of receiving your photographs (as stated for each package). Delivery times are our honest working estimates, not a guaranteed deadline, with one exception: where you give us a specific date (a service, an anniversary) and we confirm it, we treat it as binding. Each package includes the revision rounds stated on the Pricing page. You are responsible for downloading and storing your film; we recommend saving it in at least two places.
6. Your materials and your promises to us
You confirm that you own the photographs and other materials you supply, or have the right to use them and to commission us to process them, including, where living persons appear in them, that those persons (or their guardians) do not object. You must not supply unlawful content. You indemnify us against third-party claims arising from materials you supplied in breach of this section. Never send us your only physical originals; we work exclusively with digital copies you make.
7. Personalised service: cancellation
Our films are made to your individual specification. By placing an order you expressly agree that we begin work promptly, and you acknowledge that once production of your film has begun, the statutory right of withdrawal applicable to distance contracts does not apply to personalised goods and services (Art. 16(c)(d) of Directive 2011/83/EU and § 1837 of the Czech Civil Code). This does not limit our satisfaction guarantee below, which is broader than any statutory right.
8. Our satisfaction guarantee
If the finished film does not move you, tell us within 14 days of delivery and we will first offer to revise it; if you remain unsatisfied, we will refund the full price. Upon refund, your licence to the film ends and both parties delete their copies. This guarantee is voluntary and goes beyond your statutory rights, which remain unaffected.
9. Intellectual property and your licence
You receive a perpetual, worldwide licence to use your film for any personal, non-commercial purpose, including playing it at services and family gatherings and sharing it privately. We retain no right to use your film, your photographs, or excerpts for any purpose (including our portfolio and advertising) without your separate written consent. Music in the films is licensed for this use through professional licensing services; famous commercial recordings cannot be included.
10. How the films are made (AI disclosure)
Gentle photo animation is created with the assistance of specialised AI video tools and is always selected, reviewed, and edited by a person. We do not create simulated speech or "talking" likenesses of the person portrayed, and we apply only subtle, dignified motion. If a particular photograph cannot be animated to our standard, we will tell you and agree on an alternative.
11. What our service is not
Our films are keepsakes. They are not psychotherapy, counselling, or crisis support, and they are not a substitute for professional grief care. If your grief feels heavier than you can carry, please contact a grief counselor or a support group.
12. Liability
Nothing in these Terms excludes liability that cannot be excluded by law. Otherwise, our total liability in connection with an order is limited to the price you paid for that order, and we are not liable for indirect or consequential loss. We are not responsible for the content of materials you supply.
13. Governing law and disputes
These Terms are governed by the law of the Czech Republic. We will always try to resolve any concern personally and quickly: write to hello@everinlight.com first. EU consumers may use the out-of-court dispute resolution body: the Czech Trade Inspection Authority (www.coi.cz) or the EU ODR platform (ec.europa.eu/consumers/odr). Mandatory consumer-protection rules of your country of residence remain unaffected.
14. Changes
We may update these Terms; orders are governed by the version in force when the order was placed.
